  • 1. General Provisions
  1. These Sundose x Joy in Me "Secret to Longevity" Contest Rules (hereinafter: "Rules") define the terms, scope, and conditions of participation in the Sundose x Joy in Me "Secret to Longevity" Contest (hereinafter: "Contest"), organized by Sundose Sp. z o.o. with its registered office in Lublin, ul. Vetterów 1, 20-277 Lublin, e-mail: office@sundose.io, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Lublin-Wschód in Lublin with its registered office in Świdnik, 6th Commercial Division of the National Court Register under KRS number: 0000642406, NIP 712-33-20-705, with a share capital of PLN 395,500.00 (hereinafter: “Sundose”), and JOY IN ME PAULINA NIEDZIELSKA, JAGODA SCHÄPPER SPÓŁKA CYWILNA (address of place of business and correspondence address: ul. Ogrodowa 48/54, 00-876 Warsaw), partnership NIP 5272882838, partnership REGON 382567417, e-mail address: contact@joyinmepl.sbs, that is:
  1. Jagoda Schäpper, entered in the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister responsible for economy, identified by: NIP 6751280658 and REGON 356872129; and
  2. Paulina Niedzielska, entered in the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister responsible for economy, identified by: NIP 7123092902 and REGON 061411069.

  1. The Prize Funders of the Contest are Sundose and Joy in Me.
  2. The Contest is held in the territory of the Republic of Poland, via the Instagram service on the profiles @sundose.polska and @joyinme_yoga

  1. Activities related to technical support and the selection of winners are conducted by the Organizers.
  2. The Contest will run from September 8, 2022, starting from the publication of the contest post on the Instagram profiles: @sundose.polska and @joyinme_yoga and will last until September 15, 2022, at 11:59 PM.
  3. The Contest is not sponsored, administered, or organized by Instagram. Instagram bears no responsibility for the Contest.
  4. Any questions, comments, or complaints related to the Contest should be directed to the Organizers, not to Instagram. The Organizers undertake to jointly and severally release Instagram from liability to any Contest Participant who files a claim against Instagram related to the Contest.
  5. Advertising materials created for the needs of the Contest are for informational purposes only. In case of discrepancies between the wording of the advertising materials and the Rules, the wording of the Rules shall prevail.
  6. The Organizers declare that the Contest is not a game of chance, a raffle, a mutual bet, a promotional lottery where the result depends on chance, or any other form of game provided for in the Act of November 19, 2009, on Gambling Games (consolidated text, Journal of Laws of 2020, item 2094, as amended).
  • 2. Contest Participants
  1. Participation in the Contest is open only to natural persons (hereinafter: "Participant") who:
  2. a) reside in the territory of the Republic of Poland,
  3. b) are of legal age,
  4. c) are not in any way personally, financially, or organizationally related to the Organizers or the Jury appointed by the Organizers,
  5. d) have read and accept the terms of the Rules,
  6. e) have an active Instagram account,
  7. f) have correctly completed the Contest Task.
  8. Failure to meet any of the conditions specified in items a-f above is grounds for excluding the Participant from the Contest, and in the event of subsequent detection of such circumstances, including after the date of prize distribution, the Organizers have the right to claim its return.
  9. The Contest may only be participated in personally. It is forbidden to create accounts and make contest entries on behalf of third parties or to submit third parties using one's own account on the Instagram portal.
  10. Each Contest Participant may post only one contest comment.
  11. Each Participant may take part in the Contest only once, regardless of the number of accounts held on Instagram.
  • 3. Selection of Winners
  1. To ensure the proper organization and conduct of the Contest, and in particular to assess the correctness of contest entries and select winners, the Organizers will appoint a contest Jury (hereinafter: "Jury") on the day the Contest begins.
  2. To conduct the Contest, a Jury consisting of 2 persons designated by the Organizers will be appointed. The Jury will include one employee from Sundose and one employee from Joy in Me.
  3. From the submitted entries, the Jury will select and reward 2 people.
  4. In making its decision, the Jury follows a subjective assessment, taking into account the correctness of the comment. The number of likes is not taken into account.
  5. The decisions of the Jury are final and are not subject to appeal.
  6. The results of the Contest will be published on September 19, 2022. The results will be announced in a comment on the contest post and shared in an Instagram story on the @sundose.polska and @joyinme_yoga profiles by tagging the winners' accounts.
  • 4. Contest Task and Prizes
  1. To participate in the Contest, the Participant should add a comment under the contest post containing the answer to the question "What is your secret to 'longevity'?" And follow the Instagram profiles @sundose.polska & @joyinme_yoga
  2. Prizes in the Contest are:
1st place: Her Daily Longevity or His Daily Longevity product worth PLN 249.00 (two hundred forty-nine zlotys) gross and a voucher guaranteeing a 100% discount on the next order of Sundose brand products, as well as a FLOW 3mm Dive in yoga mat and palo santo from Joy in Me, with a total value of PLN 418.00.
2nd place: Her Daily Longevity or His Daily Longevity product worth PLN 249.00 (two hundred forty-nine zlotys) gross and a voucher guaranteeing a 100% discount on the next order of Sundose brand products, as well as a FLOW Coated 3 mm East West yoga mat and palo santo from Joy in Me, with a total value of PLN 418.00.

For each prize, the Organizers will award an additional cash prize in the amount of:
1st place: PLN 74.11 (of which Joy in Me will award PLN 46.44 and Sundose will award PLN 27.67)
2nd place: PLN 74.11 (of which Joy in Me will award PLN 46.44 and Sundose will award PLN 27.67)
a corresponding part of which will be deducted by each Organizer to settle the flat-rate personal income tax on the prizes awarded in the Contest (Article 30(1)(2) of the Personal Income Tax Act) and transferred to the appropriate Tax Office. The deduction of 10% flat-rate tax from the value of the prize means that the cash part of the prize will not be paid to the Winner.
  1. The prize is not exchangeable for a cash equivalent or any other type of prize, and the winner may not transfer the rights to the awarded Prize to third parties. The winner may waive the right to the awarded Prize by submitting a relevant statement to one of the Organizers at the address: marketing@sundose.io or contact@joyinmepl.sbs
  2. Details regarding the receipt and fulfillment of the Prizes mentioned in item 2 above will be communicated to the winners by one of the Organizers, who will send a message to their Instagram profile or via email within 14 days of the Contest end date.
  3. Shipping costs for the Prizes are covered entirely by Sundose and Joy in Me. Shipping is possible only within the European Union. In the case of shipping outside the European Union, delivery terms are agreed upon individually.
  4. The Organizer is not responsible for the inability to deliver or fulfill the Prize for reasons attributable to the Participant. In such a case, the Prize is forfeited.
  • 5. Participant Consents
  1. Completion of the Contest Task is equivalent to the Participant's acceptance of the provisions of the Rules without the need to submit separate statements to this effect and is equivalent to the Participant making the following declarations and commitments:
  2. a) The Contest Task constitutes an expression of the Participant's individual and original creativity. The text is the work of the Participant or a person from whom the rights to this text were acquired;
  3. b) The Participant consents to the publication of their first and last name in the event of being awarded a prize as referred to in § 4 item 2 of the Rules.
  4. The Participant consents to the dissemination of the content of the comment posted and the idea presented for purposes related to the Contest and for marketing purposes. The use of the Contest Task by Sundose and Joy in Me in accordance with the Rules will not threaten or infringe upon anyone's rights, interests, or legally protected secrets.
  5. The Participant accepts the fact that the Contest Task will be used by posting it on social media in connection with the Contest and for marketing purposes. Contest participants declare that they hold exclusive and unlimited economic and personal copyrights to the Contest Task, and that they possess the rights to freely dispose of the elements of the Contest Task (text) without infringing the rights of any third parties.
  6. In the event that the Contest Task meets the definition of a Work, the License is granted without territorial restrictions, for a period of 5 years from the posting of the Contest Task on Instagram, to use the Contest Task in connection with the Contest and marketing activities. After the 5-year period, it is converted into a license granted for an indefinite period. The license is granted in the following fields of exploitation:
  7. a) fixation and reproduction of the work, including by printing, reprography, magnetic recording, digital recording, recording in computer memory, and on other media;
  8. b) trading in the original or copies on which the work was fixed by introducing into circulation, lending, or renting the original or copies;
  9. c) dissemination, including public performance, exhibition, playing, screening, broadcasting, and re-broadcasting;
  10. d) making the Work publicly available in such a way that everyone may have access to it at a place and time chosen by them, including on the Internet.
The Participant consents to the use of the Contest Task for promotional or advertising purposes and gratuitously permits the exercise of derivative rights, including the creation, disposal, and use of adaptations of the work, along with the right to grant such permissions to third parties, as well as combining the Work with other Works. Sundose and Joy in Me have the right to grant sublicenses, to which the Participant consents upon submitting the Entry. The Participant undertakes not to exercise their moral copyrights against Sundose and Joy in Me in relation to the Contest Task. Sundose and Joy in Me may request the Winner to enter into a written agreement to transfer full economic copyrights to the Contest Task.
  1. The Participant authorizes the Organizer to anonymously disseminate Contest Tasks without signing them with the Participant's name and surname.
  2. The Organizer reserves the right to remove and exclude from the Contest any Contest Tasks:
  3. a) inconsistent with the Instagram service terms of use,
  4. b) not meeting the criteria specified in the Rules or submitted in violation of its terms,
  5. c) containing content that is contrary to good customs, immoral, offensive, or infringing applicable law;
  6. d) violating rights, in particular copyrights or personal rights of third parties, including the illegal use of the images of third parties.
  • 6. Processing of Personal Data
  1. Submitting an entry to the Contest organized by Sundose and Joy in Me constitutes consent to the processing of personal data for the purpose of participating in the Contest.
  2. In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (hereinafter: "GDPR"), Sundose and Joy in Me provide the following information regarding the processing of personal data in connection with the organized contest:

  1. Jagoda Schäpper, entered in the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister responsible for economy, identified by: NIP 6751280658 and REGON 356872129; and
  2. Paulina Niedzielska, entered in the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister responsible for economy, identified by: NIP 7123092902 and REGON 061411069.
  1. b) Data Protection Officer:
Sundose as the Administrator has appointed a Data Protection Officer. You can contact the officer regarding data protection matters, including the exercise of rights of data subjects. Contact with the aforementioned officer is possible via email at: gdpr@sundose.io or by traditional mail at: Sundose Sp. z o. o., ul. Vetterów 1, 20-277 Lublin.
  1. c) Purposes and legal bases for processing personal data:
The Administrators process data to enable you to participate in the contest for which you have submitted an entry. The basis for processing is your consent (Article 6(1)(a) of the GDPR).
  1. d) Data recipients:
The Administrators may share your personal data with their subcontractors (entities whose services they use for processing) such as:
-IT service providers;
-entities providing accounting services;
-entities providing marketing services;
-entities cooperating in the organization of the contest. The Administrators are also entitled to share personal data with other entities if such an obligation arises from legal provisions.
  1. e) The Administrators do not transfer personal data to third countries, except for sharing data with the Administrators' subcontractors (entities that process data on their behalf) who provide IT services to the Administrators; the Administrators use only entities belonging to the EU-U.S. Privacy Shield program, which ensure that their operations are GDPR-compliant.
  2. f) Data retention period:
Personal data collected for the purpose of enabling you to participate in the contest shall be stored by the Administrators for a maximum period of 10 years from the end of the contest or until the expiry of any claims related to the contest.
  1. g) Rights of data subjects:
You have the following rights:
-the right to access your personal data and the right to obtain a copy thereof;
-the right to rectify personal data;
-the right to erase personal data;
-the right to request restriction of data processing;
-the right to data portability;
-the right to object to the processing of personal data;
-the right to lodge a complaint with a supervisory authority.
Given that data processing is based on consent, you also have the right to withdraw your consent for the processing of personal data at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
In order to exercise the above rights, you may contact the Data Protection Officers.
The Administrators do not take any decisions regarding you that are based solely on automated processing, including profiling.
  1. h) Information on the voluntary or mandatory nature of providing data Providing your data is voluntary, however, failure to provide it will make it impossible to participate in the Contest.
  • 7. Complaint submission procedure
  1. Any complaints and objections regarding the conduct of the Contest may be submitted by Participants in writing or via email to the address of one of the Organizers, indicated in § paragraph 1 of the Rules, no later than within 7 days from the date of the end of the Contest.
  2. The notification should include:
  3. a) data of the Participant submitting the complaint or objections, i.e.: first name, last name, address;
  4. b) optionally, the date of the event;
  5. c) description of the complaint/objections;
  6. d) content of the request;
  7. e) description of the circumstances justifying the complaint or request.
  8. The Participant will be informed about the method of handling the complaint in the same way the complaint was submitted to the Organizer (unless the Participant requests the information to be provided in another way), within 7 days from the date of receipt of the notification by the Organizers.
  9. Any other objections, questions, comments, or complaints regarding the Contest may be addressed electronically to the Organizers' address: office@sundose.io and contact@joyinmepl.sbsm
  • 8. Provision of Services by Electronic Means
  1. The Organizers are also service providers of services provided by electronic means within the meaning of the Act of July 18, 2002, on the provision of services by electronic means (consolidated text, Journal of Laws of 2020, item 344, as amended). These rules also constitute the rules for the provision of services by electronic means within the meaning of Art. 8 of the aforementioned Act. The Organizers provide services by electronic means in accordance with these rules.
  2. Through the Website, the Organizers provide Participants with a service consisting of access to the Program application, which enables the Participant to place an order electronically.
  3. To interact with the ICT system used by the Organizers, the Participant must have equipment and a system that meets the following technical requirements:
  4. a) a computer with an internet browser supporting Cookies and JavaScript technologies;
  5. b) an internet connection;
  6. c) a properly configured email account.
  7. The Organizers warn that the use of the services specified in these rules may involve standard risks associated with the use of the Internet and recommend that Participants take appropriate steps to minimize them. The Organizers ensure the operation of an ICT system that enables the use of the service provided by electronic means in a manner that prevents unauthorized access to the content of the transmission constituting the service, in particular through the use of cryptographic techniques appropriate for the nature of the service provided, as well as unambiguous identification of the parties to the service provided by electronic means. In the event of planned breaks, upgrades, or other similar cases, the Organizers have the right to notify the Participant about them via the provided email address or generally on the website.
  8. The Participant starting to use the services covered by these rules is equivalent to concluding an agreement for the provision of services by electronic means.
  9. The Participant's consent to use the services covered by these rules may be withdrawn at any time. The termination of the agreement for the provision of services by electronic means based on these rules is effected upon the Participant's request to delete their account.
  10. The provisions of § 7 of these rules apply accordingly to complaints regarding services provided by electronic means, with the deadline for submitting a complaint counted from the moment the event justifying the submission of the complaint occurs.
  11. In matters not regulated in these rules regarding the provision of services by electronic means, generally applicable laws shall apply, in particular the Act of July 18, 2002, on the provision of services by electronic means.
  • 9. Final Provisions

  2. The governing law for all legal relationships arising in connection with the organization and participation in the Contest is Polish law.
  3. The Organizers have the right to amend the Contest Rules, provided that such amendments do not violate the acquired rights of the Participants.
  4. In the event of a change or invalidation of any of the provisions of the Rules by the decision of a competent authority or court, the remaining provisions shall remain in force and be binding on the Organizers and the Participant.
  5. In matters not regulated by the Rules, the provisions of the Sundose and Joy in Me Website Rules available at: https://sundose.io/pl/terms/sundose-web-store-rules and https://joyinmepl.sbs shall apply accordingly.
