Rules and Regulations of the "Grand Opening of the Pop Up Studio by JOY in me" contest

    1. GENERAL TERMS AND CONDITIONS

    1. The organizer and sponsor of the online contest entitled "Otwarcie Pop Up Studio JOY in me" (hereinafter: the "Contest") is Joy in me S.C., ul. Ogrodowa 48/54, 00-876 Warsaw - hereinafter referred to as the "Organizer".

    2. The terms and conditions for participation in the Contest are defined exclusively by these Contest Rules and mandatory provisions of law.

    3. The Contest is organized within the territory of the Republic of Poland.

    4. Participation in the Contest constitutes acceptance of the Contest rules contained in these Regulations. The participant undertakes to comply with the rules specified therein.

    5. The Organizer is a promisor of a prize within the meaning of Articles 919 and 921 of the Civil Code.

    6. The Organizer conducts the Contest using the Instagram portal page @joyinme_yoga @popupstudio_joyinme

    7. During the Contest, the content of the Contest Rules will be available on the Organizer's website at the following address:

    1. CONTEST DURATION

    1. The Contest runs from May 4, 2022, at 10:00:00 to May 8, 2022, at 23:59:00. ("Contest Duration").

    III. CONTEST PARTICIPANTS

    1. Individuals may participate in the Contest (hereinafter: "Participants") if they:

    1.1 are at least 13 years old, with the proviso that persons without full legal capacity (i.e., minors or partially incapacitated persons) must obtain prior consent from a legal guardian to participate in the Contest and for the processing of their personal data in accordance with the provisions of the Regulations;

    1.2 have their place of residence in the territory of the Republic of Poland;

    1.3 are consumers within the meaning of Art. 22 1 of the Civil Code.

    1. Persons employed by the Organizer or its subsidiaries, affiliates, or related companies, agencies cooperating with the Organizer, members of the Contest jury, and their families cannot be Participants in the Contest. The term "family" shall be understood as ascendants, descendants, spouses, siblings, siblings' spouses, as well as persons remaining in a de facto relationship with them or persons remaining in a relationship of adoption with them or running a joint household.

    2. The Participant takes part in the Contest independently, in their own name.

    3. Participation in the Contest is voluntary.

    4. The Organizer reserves the right to exclude Participants from the Contest, and in extreme cases to block participation in the Contest for those Participants who violate the provisions of these Regulations, in particular by:

    5.1. taking actions contrary to the law, good morals, or infringing upon the legitimate interests of third parties;

    5.2. taking actions aimed at circumventing or indicating an attempt to circumvent the Regulations or the mechanisms and rules of the Contest;

    5.3. taking actions infringing upon the legitimate interests of the Organizer or harming its image.



    1. CONTEST TASK

    2. In order to participate in the contest, the Participant must have Internet access and post a comment under the contest post answering the following question with a short justification: Tell us which of your favorite JOY products is and why.

    1. PRIZES

    1. The Main Prizes in the Contest are 10 x invitations to the Opening of the JOY in me POP UP STUDIO on May 14, 2022.

    2. The Contest Jury, consisting of representatives of the Organizer, will select 5 winning responses. Creativity, ingenuity, originality, and compliance with all formal requirements are taken into account during the evaluation.

    3. The winner of the Contest will be notified by the Organizer of the awarded prize from May 9, 2022, at 10:00:00 to May 10, 2022, at 23:59:00 via a private message on Instagram, along with details regarding how to collect the prize. The results of the contest will also be made public via so-called Instagram Stories.

    4. A necessary condition to confirm participation in the Contest and receive the Prize is for the Organizer to receive a response from the Participant within 72 hours of the moment the Participant receives the Organizer's message about the awarded prize. A winner without full legal capacity should additionally include in the message a statement from their legal guardian regarding consent for the ward's participation in the Contest.

    5. In the event that the Participant does not respond to the message from the Organizer within the specified time, they forfeit the right to receive the Prize, and the Prize remains the property of the Organizer. Before issuing the Prize, the Organizer or a person designated by them has the right to verify the Participant's age or the correctness of the consent granted by the legal guardian of the Participant who lacks full legal capacity, in particular by requesting that a scan of the Participant's identity document, or in the case of a minor Participant, a hand-signed scan of the guardian's statement consenting to participation in the Contest, along with a scan of the proof of posting such a statement, be sent via email within 5 business days to the address: contact@joyinmepl.sbs. In the event of the Participant's failure to perform the obligations set out in the previous sentence, the Prize will not be awarded and will remain the property of the Organizer.

    6. The Organizer will send the Prize to the Winner within 14 business days of receiving the Winner's message with the shipping address.

    7. A Contest Participant who has received a prize is not entitled to demand the exchange of the prize for cash or a prize of a different kind.

    8. Contest participants are not entitled to stipulate specific properties of the Prize.

    9. Contest Participants may not transfer the right to obtain the prize to third parties.

    10. A Participant may add multiple entries to the Contest but may win only one Prize.

    11. The Organizer reserves the right to control whether the Participant's conduct was in accordance with these Regulations. The Organizer has the right to refuse to issue the Prize to a Participant in the event of a breach of any point of these Regulations, and in the case of disclosure of the fact of a breach of the Regulations after the Prize has been delivered, the Organizer may demand its return. In such a case, the Prize remains the property of the Organizer, and the Participant is obliged to cover all losses incurred by the Organizer in connection with their disqualification.

    12. The Organizer is not responsible for the impossibility of issuing the Prize resulting from the Participant's failure to collect it. In such a case, the Prize remains the property of the Organizer.

    13. The Organizer stipulates that the Prize, which remains its property, may subsequently be awarded, at its discretion, to other Participants selected in accordance with the provisions of the Regulations.

    1. COMPLAINT PROCEDURE

    1. Complaints regarding the conduct of the Contest may be submitted by email to the Organizer's address, i.e., contact@joyinmepl.sbs, with the note "Contest: mayówka z JOY in me"

    2. The complaint should contain: first name, last name, the exact address of the Participant, as well as a precise description and indication of the reason for the complaint and the Participant's request.

    3. Complaints are processed by the Organizer immediately, but no later than 14 days from the date the complaint is delivered to the Organizer. The Participant will be immediately notified of the Organizer's decision at the address provided in the complaint, no later than 5 days from the date of the complaint's resolution.

    VII. PERSONAL DATA PROCESSING

    1. Data obtained in connection with the Contest will be collected in accordance with the Organizer's Privacy Policy, available at: https://joyinmepl.sbs/policies/privacy-policy. By participating in the Contest, each Participant agrees to the terms formulated within the Organizer's Privacy Policy.

    2. The Organizer is not responsible for changes (or deactivation) of the email address or the account on Instagram and/or Facebook by the Participant during the Contest and in the period necessary to select the winner and award the Prize.

    VIII. FINAL PROVISIONS

    1. In matters not regulated by these Regulations, the provisions of Polish law apply.

    2. All disputes arising from the performance of obligations related to this Contest will be settled by a competent common court.

    3. . All costs associated with participation in the Contest, including the fee for Internet access, are borne by the Contest Participant.

    4. The Organizer declares that the Contest is in no way sponsored, endorsed, administered by, or associated with the entities that own the Facebook social network.

    5. The Organizer reserves the right to amend these Regulations at any time, subject to respecting the acquired rights of the Participants.

    6. The Regulations enter into force on the day the Contest begins.
