TERMS AND CONDITIONS OF THE “200 MATS FOR POLISH YOGA” CONTEST

 


1. General Provisions

1. The organizer of the Contest is JOY IN ME PAULINA NIEDZIELSKA, JAGODA SCHÄPPER SPÓŁKA CYWILNA (registered business address and correspondence address: ul. Ogrodowa 48/54, 00-876 Warsaw, Poland), Tax Identification Number (NIP) 5272882838, Business Registration Number (REGON) 382567417, e-mail address: contact@joyinmepl.sbs, consisting of:

- Jagoda Schäpper, entered in the Central Register and Information on Economic Activity of the Republic of Poland maintained by the minister responsible for economy, holding: NIP 6751280658 and REGON 356872129; and
- Paulina Niedzielska, entered in the Central Register and Information on Economic Activity of the Republic of Poland maintained by the minister responsible for economy, holding: NIP 7123092902 and REGON 061411069.
(hereinafter referred to as the “Organizer”). 


2. These terms and conditions (hereinafter: “Terms and Conditions”) constitute the basis for the Contest conducted by the Organizer on the website joyinmepl.sbs and on the public social media account @joyinme_yoga on Instagram; they govern the rules and conditions of participation in the Contest, as well as define the rights and obligations of the Participants and the Organizer of the Contest. 
3. Participation in the Contest is equivalent to acceptance of the provisions of the Terms and Conditions. Contest participants are obliged to comply with the rules contained in the Terms and Conditions. 
4. The Contest is not subject to the provisions of the Act of November 19, 2009, on Gambling Games (Journal of Laws of 2018, item 165, as amended). 

2. Rules for participating in the contest


1. The Contest is aimed at natural persons residing in Poland and not conducting business activity (hereinafter the “Participant”). Persons with limited legal capacity (persons aged 13-18) may participate in the Contest only with the consent of their legal guardian. A condition for qualifying an entry for the Contest is holding all copyrights to it.
2. Participation in the contest and the associated provision of personal data by the Participant is completely voluntary. Participation is free of charge. 
3. The contest runs from September 19, 2022, from 7:00 AM to September 26, 2022, until 11:59 PM Polish time.
4. The Organizer reserves the right to extend the duration of the contest.
5. The contest is announced via the website www.joyinmepl.sbs and the Organizer’s public account on the Instagram social network, available at: https://www.instagram.com/joyinme_yoga/
6. Contest entries should be sent to the dedicated e-mail address: dlajogi@joyinmepl.sbs
7. The conditions for participating in the contest are:

 

a) providing an answer to the contest question via e-mail, i.e., “What is your favorite yoga pose and why?” (Contest Task)

b) submitting via e-mail a certificate of completion of a minimum 200 RYT yoga teacher training course or, alternatively, a certificate from a yoga school confirming at least 3 years of teaching practice

c) reading the content of the Terms and Conditions and acknowledging its provisions.

All of the above-mentioned conditions must be met cumulatively by the Participant. 


7. The execution of the contest task cannot contain content that: 
a) May have been posted with the intent to infringe the rights of third parties, 
b) May infringe any third-party rights, including rights related to the protection of copyright and related rights, 
c) May contain offensive, vulgar content or constitute a criminal threat directed at another person, 
d) May be contrary to the interests of the Organizer, 
e) May otherwise violate the provisions of the Terms and Conditions. 
By sending the Organizer an answer to the contest task (hereinafter: “Contest Entry”), the Participant declares that the publication of the Contest Entry does not violate the rights or personal interests of third parties and consents to the processing of personal data by the Organizer for the purposes and under the conditions specified in the Terms and Conditions. 


3. Contest resolution - Prizes and selection of Winners


 

1. To ensure the proper conduct of the Contest, the Organizer will appoint a 3-person Committee, hereinafter referred to as the Contest Committee. The duties of the Contest Committee will include overseeing the proper conduct of the Contest, making decisions on all matters concerning the Contest, including the interpretation of the provisions of these Terms and Conditions, and selecting the Participants to whom the Prizes will be awarded (hereinafter: Winners). The decisions of the Committee are final, which does not deprive the Participant of the right to pursue claims resulting from the provisions of the law.
2. After the end of the Contest, the Contest Committee will evaluate the Contest Task performed by the Participants and select among the Participants 200 (in words: two hundred) Winners who, in the opinion of the Contest Committee, have performed the Contest Task in the most attractive way.
3. The winners of the Contest will be awarded prizes: Joy in me yoga mats with a gross value of PLN 379 each. The prizes are exempt from personal income tax under Article 21, paragraph 1, point 68 of the PIT Act.
4. The Committee will finish selecting the Winners no later than September 30, 2022.
5. Contest winners will be informed about winning a Prize by a reply to the e-mail containing the Participant’s entry.
6. A condition for receiving the Prize is for the Winner to provide the Organizer within 7 days from the day the Organizer sends the notification, with the information necessary for the delivery of the Prize, including in particular: first name, last name, e-mail address, and correspondence address within the territory of the Republic of Poland.
7. In the event that the Winner fails to provide the data necessary for the transfer of the Prize within the time limit and on the terms specified in paragraph 6 above, the Contest Committee will select another Participant to receive the given Prize.
8. The Organizer is not liable for failure to deliver the Prize to the Participant if the inability to deliver the Prize resulted solely from the Participant’s failure to provide the data required for delivery or the provision of incorrect or non-compliant data.
9. Each Prize will be sent once by the Organizer to the address indicated by the Winner within the territory of the Republic of Poland within 14 days from the day the Winner sends all data enabling the shipment of the Prize in response to the notification of the awarded Prize.
10. The sponsor of the Prizes is the Organizer.
11. The Winner cannot transfer the rights to the awarded prize to a third party.
12. The Winner has the option to renounce the right to the awarded Prize by submitting a relevant written statement to the Organizer.
13. Only 1 (in words: one) Prize may be received in the Contest.
14. The prize will be sent to the Participant at the Organizer’s expense.
15. The Participant does not have the right to demand the exchange of the Prize for a cash equivalent.


4. Rights of the Organizer

1. The Organizer has the right to exclude a Participant from the Contest with immediate effect, as well as to refuse to award the Prize to the Participant if the Participant provided false or incomplete data required and necessary to award the Prize, in case of failure to comply with the provisions of the Terms and Conditions, as well as in case the Organizer obtains information about the Participant’s actions contrary to the provisions of the Terms and Conditions. 


5. Complaints

1. Any complaints related to the Contest may be submitted by the Participant until October 15, 2022. 
2. Complaints should be submitted in writing to the Organizer’s registered office address or electronically to the e-mail address: contact@joyinmepl.sbs 
In the complaint, the Participant shall state: first name and last name, correspondence address, e-mail address, and a description of the reason for the complaint and the submitted claim. The Organizer will consider complaints within 14 days of receiving them. 3. The response will be sent in the form of an electronic message to the address indicated in the complaint. 
4. The complaint procedure is voluntary and does not exclude the Participant’s right to pursue claims through legal proceedings independently of the complaint procedure. 

6. Processing of personal data

1. The personal data of Contest Participants is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter “GDPR”). 
a) Personal data of Participants are processed by the Organizer, who is the Controller of the personal data processed within the framework of the Contest. 
b) The Participant’s personal data will be processed for the purpose of: 
- conducting the Contest, which also includes accepting applications for participation in the Contest, verifying entries, selecting winners, and delivering the prize – based on the Participant’s consent (Article 6(1)(a) of the GDPR), expressed in the manner specified in § 2(9) of the Terms and Conditions, 
- fulfilling tax obligations resulting from the awarded prize – based on the Participant’s consent (Article 6(1)(a) of the GDPR), expressed in the manner specified in § 2(9) of the Terms and Conditions and the fulfillment of obligations resulting from legal provisions (Article 6(1)(c) of the GDPR),
- handling possible complaints – based on the Participant’s consent (Article 6(1)(a) of the GDPR), expressed in the manner specified in § 2(9) of the Terms and Conditions and the fulfillment of the Organizer’s legitimate interest (Article 6(1)(f) of the GDPR),
c) You can contact the Contest Organizer via: 
- Letter sent to the Organizer’s registered office address, 
- Electronic message sent to the address: contact@joyinmepl.sbs
d) Providing consent by the Participant to the processing of personal data for the purpose of participating in the Contest is voluntary. However, it is necessary for the Participant to take part in the Contest and receive the prize. The Participant has the right to withdraw their consent at any time by sending a message to the address: contact@joyinmepl.sbs
Withdrawal of consent does not affect the legality of the processing of the Participant’s data carried out before its withdrawal. 
e) The Organizer will store the Participant’s personal data for the period necessary to fulfill all obligations imposed by these Terms and Conditions, including tax obligations related to the award of the prize and the expiration of any claims of Participants that may arise in connection with the Contest. The limitation period for claims is specified by the Civil Code. 
f) The Participant’s personal data may be transferred to companies to which the Organizer commissions tasks during the organization of the Contest, based on a data processing entrustment agreement, in particular to the shipping company handling the contest and the e-mail hosting provider through which the Organizer collects entries. 
g) The Participant has the right to access their personal data and to rectify, supplement, delete, demand the restriction of data processing, and the right to data portability in situations specified by the GDPR. They may also object to the processing of their personal data. 
h) If the Participant believes that their personal data is being processed in violation of the law during the Contest, they may file a complaint with the President of the Personal Data Protection Office (UODO). 
j) Personal data of third parties were provided to the Organizer by the Participant based on the consent expressed by the third party.  
k) All decisions concerning the conduct of the Contest will be made only in the manner specified in § 3(1) of the Terms and Conditions.
